1. Acceptance of Terms

By accessing or using the services provided by San Francisco Compute ("we," "our," or "us") through our website (sfcompute.com) or any other means, you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Description of Service

San Francisco Compute provides cloud computing services, including but not limited to offering virtual machines, accelerators (such as GPUs), networking, and storage. The specific services available to you will depend on the package you select and any additional services you request.

3. User Accounts

3.1. To use our services, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2. You are responsible for safeguarding the password that you use to access our services and for any activities or actions under your password.

3.3. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Acceptable Use Policy

4.1. You agree not to use our services to: a) Violate any applicable laws or regulations b) Infringe on the intellectual property rights of others c) Transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable d) Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity e) Interfere with or disrupt our services or servers or networks connected to our services f) Conduct any activity that could damage, disable, overburden, or impair our services

4.2. We reserve the right to terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

5. Payment Terms

5.1. You agree to pay all fees associated with the services you select. Fees are non-refundable except as required by law or as explicitly stated in these Terms.

5.2. We may change our fees at any time. We will provide you with advance notice of these fee changes via email. New fees will not apply retroactively to services you have already paid for.

5.3. You are responsible for all taxes associated with the services, except for those based on our net income.

6. Data and Privacy

6.1. Our privacy practices are governed by our Privacy Policy, which is incorporated into these Terms by reference.

6.2. You retain all rights to your data. We do not own or claim ownership over any of your data.

6.3. You grant us a license to host, copy, transmit and display your data as necessary for us to provide the services in accordance with these Terms.

7. Intellectual Property Rights

7.1. The services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by San Francisco Compute, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7.2. You agree not to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our services, except as follows: a) Your computer may temporarily store copies of such materials incidental to your accessing and viewing those materials. b) You may store files that are automatically cached by your Web browser for display enhancement purposes.

8. Limitation of Liability

8.1. In no event will San Francisco Compute, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the services, including any direct, indirect, special, incidental, consequential, or punitive damages.

9. Termination

9.1. We may terminate or suspend your account and bar access to the services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

9.2. Upon termination, your right to use the services will immediately cease.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes to these Terms by posting the new Terms on this page and updating the "Last Updated" date at the top of this page.
